T.O.S

Terms of Service_{Commissioning me, purchasing an Adopt/YCH, means automatic acceptance of my T.O.S}

General
‣ You will not be receiving a physical artwork (on paper, etc.), artwork is received digitallly‣ I have the right to decline a commission if I am not comfortable with the character‣ I have the right to decline a commission if I am not comfortable with the commissioners behaviour and/or actions‣ Personal information of artist, and commissioner may not revealed to third parties‣ Follow the rules stated in this Terms of Service‣ If you have failed to follow these rules, commission, or other service being provided (YCH, Adoptable,etc.) will be cancelled.
Payment
‣ Payment must be paid in full altogether before commission is started‣ Currency that is accepted is USD (CAD is accepted as well, but only if I state beforehand).
Process
‣ WIP [Work In Progress] will only be provided if the commissioner asks for one-->Asking for WIP's may slow down the art process, resulting to a longer wait time, asking for a WIP means you/commissioner agree to this<--‣ A WIP may be sent to commissioner for any concerns/questions regarding the artwork or character‣ Do not rush, or constantly ask if I am done, please understand drawing good quality art takes time‣ Wait time is anywhere from 1 month to 3 months, if complications occur you/commissioner will be notified right away.
Completion of Order
‣ After the order is complete only small changes can be made without charge such as small item (bracelet, hair clip, etc), or easy colour fixes (make sure the reference is clear in the first place)‣ Bigger changes will result to charge of fee (ex, adding wings or jacket, etc.)‣ Order will not be completely re-done if it has already been completed.
Refund & Cancelling Policy
‣ If I have not already started on the order, and a cancel of order has been asked for, then a 100% refund will be given‣ If the sketch has already been drawn, and a cancel of order has been asked for, a 50% refund is available (the sketch will not be given to commissioner, it will be scrapped or character will be changed, unless I (Moraii) state otherwise)‣ If lineart has been completed, and a cancel of order has been asked, there is no refund of money, as a lot of time has already been taken up‣ If artwork is completely finished there will not be any refund‣ Overall if any sort of cancellation has been asked for, by the commissioner/you, the artwork will not be given no matter what stage it is in, unless I (Moraii) state otherwise.
Copyright & Usage Policy
‣ I, (@Moraii), hold every right to the artwork/drawing that is produced by me‣ Meaning I am allowed to do whatever I would like with the artwork; promote myself, upload anywhere, publish it, etc. (proper credit to owner of character will be given)‣ The commissioner may use the artwork for personal use only‣ The commissioner may print artwork for personal use only, they may not use it for commercial use such as selling the image/prints‣ The commissioner may claim character as their own (if it rightfully belongs to them)‣ The commissioner may use the artwork to promote themselves with proper credit given to me, (@Moraii), the artist‣ The commissioner may not use artwork in any commercial way; making a profit from the artwork in anyway or form‣ The commissioner may not claim artwork as their own, or trace/copy the artwork‣ The commissioner may not change, remove, or alter the watermark/signature.
Commercial Rights
‣ Commercial rights for not bulk of products (social media artwork, promotional material, CD cover, game assets, etc.) with visible small watermark is 3x price‣ Commercial rights for bulk of products (postcards, merchandise, body pillows, etc.) with no visible watermark for small business is 4x price‣ Commercial rights for bulk of products (postcards, merchandise, body pillows, etc.) with no visible watermark for large business is 5x price‣ Commercial rights pricing may change depending on style (such as cell-shading style price may increase more than what is written above) and character; commercial pricing should be discussed with me (Moraii) for an exact amount
